Is there any issue diverting rain water from guttering to open drain?

Hi all. I live in a 1920’s house, the guttering coming from the roof has a spout which comes out on the cobbled drive. Over time the water has started to make the porch have some damp issues. I’ve bought a water butt to divert the gutter water into but with heavy rain this fills up too quickly. My father in law has attached a hose to it, run it around the front of the house and to the end of the drive. The water is currently going from my gutters onto the sloped pavement and ends up directly into the open drain on the side of the road. I’m just wondering what the legalities are of this? The drain collects the rain water from the road so I’m not adding any other substances which would normally go down there? Thanks!

Yes because Gutters and gullies should only collect rainwater and connect to the rainwater drain. Wastewater pipes should not be connected to the rainwater system. If the rainwater gutters and gullies are connected to the wastewater drain, rainwater could overwhelm the drain and cause flooding.

It sounds like the natural fall of the land runs towards the storm drain in the road anyway. When paying your water rates you’ll notice a section covering the road drainage around your property also. It is generally legal to divert rainwater from your property to the street or a public drain as long as it does not cause any damage, flooding or blockages. However, it is always best to check with your local council or water authority to ensure you are not in breach of any regulations or bylaws. Additionally, it is important to consider the impact your actions may have on the environment and neighboring properties.

No if it an open drain on your property your fine its what they are there for. It shouldn’t be a problem diverting it the correct way maybe time to replace gutters and move outlets nearer to the drain.
